Terms of Use

These Terms of Use ("Terms") are an agreement between you and the developer of the RIDE app, established in Belgium ("RIDE", "we", "us"). They apply to the RIDE app for iPhone and iPad, to the routes, workouts and other content we provide in it, and to this website (together, the "Service").

Please read these Terms carefully. Section 5 on health and safety is especially important, because RIDE controls the resistance of your trainer and can ask for maximum effort.

1. Agreement

By creating an account, or by downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle your personal data.

Nothing in these Terms limits the rights you have as a consumer under the mandatory law of the country where you live.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may only use the Service with the permission of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Service.

You may only use the Service if your health allows it. See section 5.

3. Your account

You need an account to use RIDE, which you create with Sign in with Apple. Your account is personal. You are responsible for keeping your device and your Apple Account secure, and for everything that happens under your account. Tell us as soon as possible if you suspect that someone else is using it.

RIDE uses the details in your profile, such as your weight and your FTP, to calculate trainer resistance and training targets. Keep them accurate and up to date. Incorrect values lead to a training load that does not suit you.

You can export your data and delete your account at any time under Settings in the app. Deleting your account does not cancel a subscription. See section 9.

4. Licence and acceptable use

For as long as you comply with these Terms, we grant you a personal, non-exclusive, non-transferable and revocable licence to install and use RIDE on Apple devices that you own or control, for your own non-commercial training.

5. Health and safety

What RIDE does. RIDE controls the resistance of your smart trainer. It changes that resistance automatically, to follow the gradient of a route or the power target of a workout. Workouts and FTP tests can require sustained or maximum effort. Strenuous exercise carries inherent risks, including injury, heart problems and, in rare cases, death.

Before you start. Consult a doctor before you use RIDE for the first time, and regularly while you keep using it. This matters most if you:

Do not use RIDE against the advice of your doctor.

While you ride. Stop immediately and seek medical help if you feel pain or pressure in your chest, dizziness, faintness, nausea, an irregular heartbeat, unusual shortness of breath or any other sign that something is wrong. You stay in control at all times: you can stop pedalling or end the ride whenever you want, and no workout, test or route is worth continuing when you feel unwell.

No medical advice. RIDE is not a medical device and we are not a healthcare provider. Workouts, FTP estimates, training zones and the power, heart rate and other figures RIDE shows are general training information. They are not medical advice, diagnosis or treatment, and using RIDE does not create a doctor-patient relationship. The figures depend on your sensors and on your profile and may be inaccurate. Never rely on them for a medical decision, and never ignore medical advice or delay seeking it because of something in RIDE.

Your setup. RIDE is made for indoor use on a stationary trainer only. Do not use it while riding outdoors or in traffic. Make sure that your bike and trainer are installed and maintained according to the manufacturer's instructions and stand stable, that you have enough space and ventilation, that you drink enough, and that children and pets stay away from moving parts.

Your responsibility. You decide whether you train, which session you ride and how hard you push. You take part voluntarily and, to the extent the law allows, at your own risk. Section 13 explains what this means for our liability.

6. Equipment and compatibility

To use RIDE you need a compatible iPhone or iPad and a Bluetooth trainer or sensors. We do not supply this equipment. RIDE works with common Bluetooth standards for trainers, power meters and heart rate monitors, but manufacturers implement these differently and change them through firmware updates. We cannot guarantee that every device works with RIDE, or keeps working. Our Support page has more information.

You are responsible for your equipment, for how it is installed and maintained, and for following the manufacturer's instructions and limits, which take priority over anything RIDE shows or asks.

Power, cadence and heart rate come from your own devices, and their accuracy depends on those devices. Speed, distance and elevation in RIDE are simulated and will differ from riding outdoors.

Some features need an internet connection. Any data charges are yours.

7. Your content

Your content is the information you add to RIDE: your profile, your rides, the routes you import, the workouts you create and the messages you send to support.

Your content stays yours. Your profile, rides, routes and workouts are stored on your device and in your own iCloud account, where we cannot access them, so we do not need or take a licence to them. When you send us a support message, you allow us to use it and the technical details you include to answer you and to solve the problem. If you send us ideas or suggestions, we may use them freely and without any obligation to you.

You are responsible for your content. Only import files, such as GPX routes, that you have the right to use. RIDE processes imported routes automatically and we do not review them, so their gradient and elevation may be inaccurate.

You are responsible for keeping your iCloud account available and for exporting anything you want to keep before you delete your account.

8. Third-party services

RIDE relies on, or can connect to, services run by others:

These services are subject to their own terms and privacy policies, which apply to you when you use them. We are not responsible for their availability, for their content or for what they do with data you send to them. Features that depend on a third party may change or stop when that party changes its service.

RIDE is not affiliated with, sponsored by or endorsed by any of these parties or by any trainer or sensor manufacturer. Their names and trademarks belong to their owners.

9. Subscriptions and purchases

Free and paid features. Some features of RIDE may require a paid subscription. The price, including taxes, and the length of the subscription period are shown in the app before you buy.

Billing through Apple. Purchases are made through the App Store with your Apple Account. Apple charges you and processes the payment under its own terms. We do not receive your payment details.

Free trial. If we offer a free trial, it turns into a paid subscription at the end of the trial period, unless you cancel at least 24 hours before it ends. A free trial is available once per Apple Account.

Automatic renewal. A subscription renews automatically for the same period and at the price that applies at that time, unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within 24 hours before the end of the current period.

Cancelling. You manage and cancel your subscription in your Apple Account settings on your device. Deleting the app or your RIDE account does not cancel it. After you cancel, you keep access to the paid features until the end of the period you paid for.

Price changes. We may change the price of a subscription. Apple will tell you in advance and, where required, ask for your consent. If you do not agree, your subscription ends at the end of the current period.

Withdrawal and refunds. Because your purchase is made with Apple, Apple handles refunds and the statutory right of withdrawal, which for consumers in the European Union is 14 days from the purchase. You can submit a request at reportaproblem.apple.com. We cannot issue refunds ourselves. Apart from this, payments for a period that has already started are not refunded, unless the law requires it.

Restoring purchases. If you reinstall RIDE or change device, you can restore an active subscription in the app.

10. Availability and changes to the Service

We work to keep the Service available and running well, but we cannot promise that it is always available, uninterrupted or free of errors. Maintenance, updates, problems at third parties and events beyond our control can interrupt it.

We may add, change or remove features, routes and workouts, for example to improve the Service, for technical or security reasons, because a licence or a third-party service changes, or to comply with the law. If a change has a more than minor negative effect on the paid features you use, we will tell you in advance and you may end your subscription.

Keep RIDE up to date. Older versions of the app, and older versions of iOS and iPadOS, may stop being supported.

If we decide to discontinue the Service, we will give you reasonable notice in the app so that you can export your data.

11. Intellectual property

The Service, including the software, the design, the RIDE name and logo, the texts and the routes and workouts we provide, belongs to us or to our licensors and is protected by copyright, trademark and other laws. Apart from the licence in section 4, these Terms give you no rights to it.

RIDE includes open source software and open data, which remain subject to their own licences. These are listed in the app under Acknowledgements and take priority over these Terms for the components they cover.

12. Legal guarantee and warranties

If you are a consumer in the European Union, you benefit from the legal guarantee of conformity for digital content and digital services. If RIDE does not work as it should, contact us and we will look for a solution.

Beyond that, and to the extent the law allows, the Service is provided "as is" and "as available". We give no further warranty, express or implied. In particular, we do not promise that the Service will meet your expectations or produce a particular training result, that it works with every device, or that the data it shows is accurate or complete.

13. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our acts or omissions, for fraud, wilful misconduct or gross negligence, or for anything else for which the law does not allow liability to be excluded or limited.

Subject to the paragraph above, we are not liable for:

Subject to the first paragraph of this section, our total liability to you for all claims arising in any period of 12 months is limited to the amount you paid for RIDE in the 12 months before the event that gave rise to the claim, or EUR 50 if that is higher.

14. Suspension and termination

You can stop using the Service at any time and delete your account under Settings in the app. Cancel any subscription separately through Apple, as described in section 9.

We may suspend or end your access to the Service if you seriously or repeatedly breach these Terms, if the law requires us to, or if we discontinue the Service. Where that is reasonable, we will warn you first and give you the chance to put things right.

When the agreement ends, your licence to use RIDE ends. The data on your device and in your iCloud account remains yours. Sections 5, 7, 11, 13, 17 and 18 continue to apply.

15. Changes to these Terms

We may change these Terms, for example when the Service changes, when we introduce new features, for security reasons or when the law changes. The current version is always on this page, with the date of the last update at the top.

If a change is material, we will tell you in the app or by email at least 30 days before it takes effect. If you keep using the Service after that date, you accept the new Terms. If you do not agree, stop using the Service and cancel your subscription before the change takes effect.

17. Governing law and disputes

These Terms are governed by Belgian law. If you are a consumer, you also keep the protection of the mandatory rules of the law of the country where you live.

If you have a complaint, contact us first at info@ride-app.eu. We will do our best to resolve it with you.

If we cannot resolve it together, consumers can turn to the Belgian Consumer Mediation Service at consumerombudsman.be for an out-of-court settlement.

Disputes can be brought before the Belgian courts. If you are a consumer, you may also bring proceedings before the courts of the country where you live.

18. General

These Terms, together with the terms shown to you when you make a purchase, are the entire agreement between you and us about the Service.

If a provision of these Terms turns out to be invalid or unenforceable, the other provisions remain in force, and the invalid provision is replaced by a valid one that comes as close as possible to what was intended.

If we do not enforce a provision, that does not mean we waive it.

You may not transfer your rights or obligations under these Terms to anyone else. We may transfer ours to a party that takes over the Service, provided your rights under these Terms are not reduced.
